1. Agreement to these terms

These Terms & Conditions ("Terms") govern your use of www.getasave.com and purchases from GetASave LLC ("GetASave," "Seller," "we," "us," or "our"). By using the storefront or submitting an order, you agree to these Terms, the Privacy Policy, Shipping Policy, and Return & Refund Policy.

If you do not agree, do not use the storefront or submit an order. You must be at least 18 years old and able to enter into a binding contract to make a purchase.

2. Product information and vehicle fitment

We work to provide accurate product descriptions, images, specifications, and vehicle-fitment information. Manufacturers and suppliers may change designs, packaging, specifications, or superseded part numbers without notice.

Vehicle year, make, and model are not always sufficient to determine fitment. Engine, trim, production date, drivetrain, emissions configuration, VIN, and installed options may matter. Review the complete product information and contact us before ordering if fitment is uncertain. Professional inspection and installation are recommended for safety-critical parts.

3. Orders and acceptance

An order is an offer to purchase. We may accept, reject, limit, hold, or cancel an order for inventory, pricing, payment, fraud, shipping, legal, safety, or supplier reasons. An order confirmation acknowledges receipt and does not guarantee acceptance, inventory, price, or delivery.

If we cancel an order after payment has been authorized or collected, we will void the authorization or refund the affected amount to the original payment method.

4. Prices, currency, tax, and errors

Prices and availability may change without notice. The storefront may display USD or CAD based on your selection or market, but the final currency, discounts, shipping, tax, and total are shown at hosted checkout before you submit the order.

We may correct typographical, catalog, pricing, discount, or availability errors and cancel an affected order. Applicable sales, use, import, and similar taxes or charges are added where required.

5. Payment and checkout

Checkout and payment processing are hosted by Shopify and its payment partners. You represent that you are authorized to use the payment method and that the billing information is accurate. Payment authorization may occur when the order is submitted, with capture or adjustment according to the checkout and fulfillment process.

6. Shipping, returns, and refunds

Shipping is governed by our Shipping Policy. Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy. Those policies are incorporated into these Terms.

7. Installation, use, and legal compliance

Automotive parts can affect vehicle safety, emissions, warranty coverage, and legal compliance. You are responsible for lawful selection, installation, inspection, maintenance, and use of products. Follow the vehicle and product manufacturer instructions and use a qualified technician when appropriate.

GetASave is not responsible for damage caused by incorrect selection, improper installation, misuse, modification, racing, neglected maintenance, or use that violates law or manufacturer instructions.

8. Manufacturer warranties

Products may carry warranties provided by their manufacturers. Unless expressly stated in writing by GetASave, those warranties are provided by the manufacturer, not GetASave, and are subject to the manufacturer terms and claim process. We may assist with information reasonably available to us.

9. Acceptable use

You may not misuse the storefront, interfere with its operation, attempt unauthorized access, introduce malicious code, scrape or harvest data in violation of law or these Terms, impersonate another person, submit fraudulent orders, or use the services for unlawful purposes.

10. Intellectual property

The GetASave name, storefront design, software, text, graphics, and other original content are owned by GetASave or its licensors and are protected by applicable intellectual-property laws. Product names, logos, and trademarks belong to their respective owners. No rights are granted except the limited right to use the storefront for lawful personal or business shopping.

11. Third-party services and links

The storefront depends on third-party services, including Shopify, payment processors, carriers, suppliers, and catalog or search providers. Third-party services and linked sites are governed by their own terms. We are not responsible for third-party content or acts beyond our reasonable control.

12. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE STOREFRONT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." EXCEPT FOR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED AND ANY EXPRESS WRITTEN PRODUCT WARRANTY, GETASAVE DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETASAVE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING FROM THE STOREFRONT, A PRODUCT, OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETASAVE'S AGGREGATE LIABILITY FOR A CLAIM RELATING TO A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT YOU PAID GETASAVE FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold GetASave and its affiliates, personnel, and service providers harmless from third-party claims arising from your unlawful misuse of the storefront, violation of these Terms, or improper installation, modification, or use of a product.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Before filing a claim, you and GetASave agree to make a good-faith effort to resolve the dispute by contacting the other party.

16. General terms

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer or by operation of law.

We may update these Terms by posting a revised version with a new last-updated date. The version in effect when an order is submitted governs that order unless applicable law requires otherwise.
